Terms or Services

1. Introduction and Definitions
These Terms of Service ("Terms") govern the provision of domestic staff referral and placement services ("Services") by Steadfast Consulting and Resourcing Services Pvt Ltd ("Company," "We," "Us," or "Our"), operating under the trademark "homeaide.in". The "Client" ("You," "Your") refers to any individual or entity engaging Our Services. By registering and paying the fee, You acknowledge that You have read, understood, and irrevocably agree to be bound by these Terms in their entirety.

2. Nature of Service; No Employment Relationship
The Company acts solely as an introductory and referral agency. We facilitate the introduction of potential domestic staff (e.g., nannies, drivers, maids, cooks) to the Client. The Company is NOT the employer of any staff introduced. Upon introduction, any and all employment relationships, whether formal or informal, are strictly between the Client and the staff member. The Client is solely and exclusively responsible for all employer obligations.

3. Client's Sole Responsibility for Employment
You, the Client, expressly acknowledge and agree that you assume full and sole responsibility for:

Conducting all necessary background checks, verification of credentials, references, police records, and medical fitness of any staff member prior to and during employment.
Executing a formal employment contract, defining terms, duties, and conditions.
Payment of all salaries, wages, bonuses, statutory contributions (PF, ESI), gratuity, and providing any mandated benefits.
Compliance with all applicable central, state, and local labour laws, including but not limited to The Minimum Wages Act, The Payment of Wages Act, The Domestic Workers Act (where applicable), and any other social security legislation.
Obtaining adequate insurance, including but not limited to employer's liability insurance, third-party liability insurance, and property insurance.
Providing a safe working environment, clear instructions, and proper supervision.

4. Registration and Finder's Fee
A non-refundable registration fee of ₹1,000 is payable to initiate the search process. The agreed-upon finder's fee/placement fee is payable in full upon the Client's formal offer of employment to a candidate or at the commencement of employment, whichever is earlier. This fee is for the service of introduction and is non-refundable under any circumstances.

5. Term and Replacement Guarantee
This Agreement is valid for one (1) year from the date of the first staff introduction. During this period, if a placed staff member voluntarily resigns or is terminated by the Client, We will provide up to three (3) replacement introductions at no additional finder's fee, subject to the candidate's availability. This guarantee is void if the Client breaches these Terms, fails to pay the staff's dues, or provides unsafe/illegal working conditions.

6. Comprehensive Disclaimer of Warranties and Liability
THE SERVICES AND STAFF INTRODUCTIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO REPRESENTATIONS OR GUARANTEES REGARDING THE SUITABILITY, CHARACTER, CREDENTIALS, EXPERIENCE, OR BACKGROUND OF ANY STAFF MEMBER.

7. Limitation of Liability and Hold Harmless
IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising from or related to the acts, omissions, conduct, or performance of any domestic staff member introduced by Us. This includes, but is not limited to:

Theft, loss, or damage to Client property (movable or immovable).
Any form of personal injury, accident, or harm to the Client, Client's family, guests, or third parties.
Any breach of trust, misconduct, negligence, or illegal activity by the staff.
Any disputes, legal proceedings, or liabilities arising from the employment relationship.
The Client agrees to indemnify, defend, and hold harmless the Company from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) brought by any party in connection with the employed domestic staff.

8. Jurisdiction, Severability, and Amendments
These Terms shall be governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai. If any provision is found invalid, the remainder shall remain in full force. The Company reserves the right to amend these Terms at any time, with continued use of Services constituting acceptance.

9. Acknowledgment
By proceeding with payment and using Our Services under the "homeaide.in" trademark, You confirm that You have independently assessed these Terms, understand that You bear all employment risks, and absolve the Company of all related liabilities.
