Service Agreement

These Terms govern the provision of domestic staff referral and placement services by HomeAide.

1. Nature of Service

HomeAide acts solely as an introductory, facilitation, and referral agency. We do not employ, supervise, control, or direct any staff, and we do not provide domestic services ourselves.

Any employment, contractual, or service relationship is strictly between the Client and the staff member. Nothing in these Terms creates an employment relationship, partnership, joint venture, or principal-agent relationship between HomeAide and any staff member.

2. Registration & Fees

A non-refundable registration fee of ₹2,000 is payable to initiate the search process. This fee covers administrative processing, candidate sourcing, and onboarding effort, which commence immediately upon payment.

The agreed-upon finder's/placement fee is payable in full upon the Client's formal offer of employment, or at the commencement of employment, whichever is earlier.

All fees are non-refundable except where expressly mandated by law. Applicable GST will be charged in addition.

3. Replacement Guarantee

Agreement valid for one (1) year from the date of first staff introduction.

If a placed staff member voluntarily resigns or is terminated, we provide up to three (3) replacement introductions at no additional finder's fee, subject to candidate availability.

Replacement support is non-transferable and is not convertible into a refund. Guarantee void if Client breaches Terms, fails to pay staff dues, or provides unsafe/illegal working conditions.

4. Client Responsibilities

  • Independent background verification (police, ID, address, references, antecedents)
  • Execute a formal employment contract defining duties, hours, leave, and termination
  • Payment of all wages, overtime, bonuses, and statutory contributions
  • Compliance with the Code on Wages 2019, Code on Social Security 2020, Industrial Relations Code 2020, and Occupational Safety, Health and Working Conditions Code 2020
  • Adequate insurance (employer's liability, third-party liability)
  • Safe, lawful, and humane working conditions

5. Disclaimer & Liability

Services and staff introductions are provided "AS IS" and "AS AVAILABLE", without warranties of any kind. HomeAide makes no guarantees regarding suitability, character, credentials, or background of any staff member.

HomeAide shall not be liable for any loss, damage, injury, theft, misconduct, or negligence by any staff member. Total liability, if any, shall not exceed the fees paid by the Client in the preceding 12 months.

The Client agrees to indemnify and hold HomeAide harmless from claims arising from any staff engagement or dispute.

6. Jurisdiction & Grievances

These Terms are governed by the laws of India. Courts at Mumbai have exclusive jurisdiction. HomeAide may amend these Terms at any time; continued use constitutes acceptance. Nothing herein affects non-waivable statutory rights available under applicable law.
